1.1 Introduction:
Superhuman LLC d/b/a Superhuman (“Superhuman,” “we,” “us,” “our”) provides its services (described below) to you through it’s mobile applications and related services (collectively, such services, including any new features and applications, and the Site, the “Service(s)”), subject to the following Terms of Service (the “Terms of Service”). PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY GOVERN YOUR USE OF THE SITE AND SERVICES, PARTICULARLY SECTION 10 (BINDING ARBITRATION; CLASS ACTION WAIVER), WHICH AFFECTS YOUR RIGHTS IN THE EVENT OF A DISPUTE BETWEEN US. When you create a Superhuman account or use Superhuman, you agree to these terms.
1.2 Modifications to Terms of Service:
We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time. Except as set forth in Section 10.11 below, which governs changes to the dispute resolution (Binding Arbitration and Class Action Waiver) provisions of these Terms of Service, if we do modify these Terms of Service, depending on the nature of the change, we will post the changes on this page and indicate at the top of this page the date these terms were last revised and/or notify you, either through the Services' user interface, in an email notification or through other reasonable means and as required by applicable law. Any such changes will become effective no earlier than fourteen (14) days after they are posted, except that changes addressing new functions of the Services or changes made for legal reasons will be effective immediately. Your continued use of the Service after the date any such changes become effective constitutes your acceptance of the new Terms of Service. In addition, when using certain Services, you will be subject to any additional terms applicable to such Services that may be posted on the Service from time to time.
1.3 Privacy:
At Superhuman, we respect the privacy of our users. For details please see our Privacy Policy. The Privacy Policy explains how we collect and use information. It also explains the many ways you can control your information. You must agree to the Privacy Policy to use Superhuman. Providing our Service requires collecting and using your information. By using the Service, you consent to our collection and use of personal data as outlined therein.
1.4 How Our Service Is Funded
Instead of paying to use Superhuman, by using the Service covered by these Terms, you acknowledge that we can show you ads that businesses and organizations pay us to promote on and off Superhuman. We use non-personally identifiable data, such as information about your activity and interests, to show you ads that are more relevant to you.
We show you relevant and useful ads without telling advertisers who you are. We do not sell your personal data to third parties. We allow advertisers to specify their business goals and the types of audiences they want their ads to reach, such as age groups, interests, or fitness levels. We then show their ad to people who might be interested.
We also provide advertisers with reports about the performance of their ads to help them understand how people are interacting with their content on and off Superhuman. For example, we provide general demographic and interest information to advertisers to help them better understand their audience. We don’t share information that directly identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you give us specific permission.
You may see branded content on Superhuman posted by account holders who promote products or services due to a commercial relationship with a business partner. We will clearly indicate when content is sponsored to ensure transparency.
To the extent the Service or any portion thereof is made available for any fee, you will be required to select a payment plan and provide Superhuman information regarding your credit card or other payment instrument. You represent and warrant to Superhuman that such information is true and that you are authorized to use the payment instrument. You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur. You agree to pay Superhuman the amount that is specified in the payment plan (as well as any applicable taxes) in accordance with the terms of such plan and this Terms of Service. You hereby authorize Superhuman to bill your payment instrument in accordance with the terms of the applicable payment plan (as well as any applicable taxes) until you terminate your account, and you further agree to pay any charges so incurred. If you dispute any charges, you must notify Superhuman in writing within sixty (60) days from the date the charge was made. Failure to do so may result in the charge being considered final and non-refundable. We reserve the right to change Superhuman's prices. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the changed amount. You shall be responsible for all taxes associated with the Services other than U.S. taxes based on Superhuman's net income.
2.1 Use Description
We agree to provide you with the Superhuman Service. The Service includes all of the Superhuman products, features, applications, services, technologies, and software that we provide to advance Superhuman's mission: making education from the most influential minds accessible to all, regardless of location or income. The Superhuman Service, and any content viewed or accessed through our Service, is solely for your personal and non-commercial use.
When you access the Superhuman Service, we grant you a limited, non-exclusive, non-transferable license to access and view Superhuman content, including both streamed videos and structured content in our unique format. This license allows you to interact with guides and other content through the Service on a streaming-only basis and within the structured format provided. No other rights, titles, or interests are transferred to you. You agree not to use the Service or its content for public performances, commercial purposes, or any other purpose beyond personal use.
Superhuman reserves the right to revoke your license at any time, at its sole discretion, without prior notice. Upon such revocation, you must promptly destroy all content downloaded or otherwise obtained through the Service, as well as copies of such materials, whether made in accordance with these Terms of Service or otherwise.

People are different. So we offer you different types of accounts and features to help you create, share, grow your presence, and communicate with people on and off Superhuman. We aim to empower you to build meaningful relationships and share experiences that truly matter to you. We build systems that try to understand who and what you and others care about, using that information to help you create, find, join, and share experiences that resonate with you. Part of that is highlighting content, features, offers, and accounts that you might be interested in, and offering ways for you to experience Superhuman, based on things that you and others do on and off Superhuman.
Fostering a positive, inclusive, and safe environment.
We develop and use tools and offer resources to our community members that help to make their experiences positive and inclusive, including when we think they might need help. We also have teams and systems that work to combat abuse and violations of our Terms and policies, as well as harmful and deceptive behavior. To maintain platform security, we use all available information, including data you provide, to detect and prevent abuse, violations, and harmful behavior. Developing and using technologies that help us consistently serve our growing community.
Organizing and analyzing information for our growing community is central to our Service. A big part of our Service is creating and using cutting-edge technologies that help us personalize, protect, and improve our Service on an incredibly large scale for a broad global community. Technologies like artificial intelligence and machine learning give us the power to apply complex processes across our Service. Automated technologies also help us ensure the functionality and integrity of our Service.
Ensuring access to our Service.
To operate our global Service, we must store and transfer data across our systems around the world, including outside of your country of residence. This global infrastructure is essential for delivering our Service, and we take steps to ensure your data is protected during storage and transfer. This infrastructure may be owned or operated by Superhuman LLC or its affiliates.

We utilize data from Superhuman and third-party partners to present you with ads, offers, and sponsored content that align with your interests. Our goal is to make this content as relevant and engaging as your other Superhuman experiences.
Research and innovation.
We leverage the information we collect to continuously improve our Service and collaborate on research initiatives aimed at enhancing user experience and contributing to the broader well-being of our community.
2.2 Your Registration Obligations
You may be required to register with Superhuman in order to access and use certain features of the Service. If you choose to register for the Service, you agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the Service’s registration form. Registration data and certain other information about you are governed by our Privacy Policy.
If you are under 13 years of age, you are not authorized to use the Service, with or without registering. However, we recognize that Superhuman can be a valuable tool for youth training and family activities when managed by responsible adults. Therefore, if you are under 13, a parent, guardian, or authorized coach must register on your behalf and supervise your use of the Service.
If you are between 13 and 18 years old, you may use the Service, with or without registering, only with the approval of your parent, guardian, or authorized coach. They are responsible for monitoring your use of the Service and ensuring compliance with these Terms of Service.
2.3 Who Can Use Superhuman
We want our Service to be as open and inclusive as possible, but we also want it to be safe, secure, and in accordance with the law. To be part of the Superhuman community, you must agree to the following restrictions:
2.4 Member Account, Password and Security.
You are responsible for maintaining the confidentiality and security of your account information, including your password. You may never use another person's account, and you may not provide another person with your username and password to access your account, except in the case of a parent, guardian, or authorized coach managing an account on behalf of a minor under 13 years of age, or supervising a minor between 13 and 18 years old.
If you are a parent, guardian, or authorized coach managing an account for a minor, it is your responsibility to ensure that the account is used appropriately and securely. You should maintain control over all of the devices that are used to access the Service, especially those used by the minor. If you fail to maintain control of a device, unauthorized users may access the Service through your account and may be able to access certain account information.
You are fully responsible for any and all activities that occur under your password or account, whether performed by you, the minor you supervise, or others. It is your responsibility to ensure that your password remains confidential and secure. You agree to (a) immediately notify Superhuman of any unauthorized use of your password or account, or any other breach of security, and (b) ensure that you or the minor you supervise exit from the account at the end of each session when accessing the Service.
Superhuman will not be liable for any loss or damage arising from your failure to comply with this Section.
2.5 Permissions You Give to Us.
As part of our agreement, you also give us the permissions we need to provide the Service.
We do not claim ownership of your content, but you grant us a license to use it.
Nothing is changing about your rights to your content. We do not claim ownership of the content you post on or through the Service, and you are free to share your content with anyone else, wherever you want. However, we need certain legal permissions from you (known as a “license”) to provide and enhance the Service. When you share, post, or upload content that is covered by intellectual property rights (such as photos, videos, or structured content) on or in connection with our Service, you hereby grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). This license allows us to operate, develop, and promote the Service in ways that are aligned with your usage and privacy settings.
This license will end when your content is deleted from our systems. You can delete content individually or all at once by deleting your account. Note that if your content has been shared with others who have not deleted it, or if it is used in public areas of the Service, it may continue to appear even after you delete it from your account. To learn more about how we use your information and how you can control or delete your content, please review the Privacy Policy.
Permission to use your username, profile picture, and information about your relationships and actions with accounts, ads, and sponsored content.
You give us permission to display your username, profile picture, and information about your actions or relationships next to or in connection with accounts, ads, offers, and other sponsored content that you follow or engage with, without any compensation to you. For example, we may show that you liked a sponsored post created by a brand that has paid us to display its ads on Superhuman. As with actions on other content and follows of other accounts, actions on sponsored content and follows of sponsored accounts can only be seen by people who have permission to see that content or follow. We will respect your ad settings and privacy controls, ensuring that you have control over how your interactions are displayed.
You agree that we can download and install updates to the Service on your device.
2.6 Additional Rights We Retain
Modifications to Service.
Superhuman reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Superhuman will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. We have no obligation to retain any of Your Account or Submitted Content for any period of time beyond what may be required by applicable law.
If you select a username or similar identifier for your account, we may change it if we believe it is appropriate or necessary (for example, if it infringes someone's intellectual property or impersonates another user).
If you use content covered by intellectual property rights that we have and make available in our Service (for example, images, designs, videos, or sounds we provide that you add to content you create or share), we retain all rights to our content (but not yours).
You can only use our intellectual property and trademarks or similar marks with our prior written permission.
You must obtain written permission from us or under an open source license to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.
2.7 Content Removal and Disabling or Terminating Your Account
General Practices Regarding Use and Storage
You acknowledge that Superhuman may establish general practices and limits concerning the use of the Service, including, without limitation, the maximum period of time that data or other content will be retained by the Service and the maximum storage space that will be allotted on Superhuman’s servers on your behalf. You agree that Superhuman has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded by the Service. You acknowledge that Superhuman reserves the right to terminate accounts that are inactive for an extended period of time. You further acknowledge that Superhuman reserves the right to change these general practices and limits at any time, at its sole discretion, with or without notice.
Content Retention and Account Deletion
We can remove any content or information you share on the Service if we believe that it violates these Terms of Service, our policies, or if we are permitted or required to do so by law. We can refuse to provide or stop providing all or part of the Service to you immediately to protect our community or services, or if you create risk or legal exposure for us, violate these Terms of Service or our policies, if you repeatedly infringe other people's intellectual property rights, or where we are permitted or required to do so by law. We can also terminate or change the Service, remove or block content or information shared on our Service, or stop providing all or part of the Service if we determine that doing so is reasonably necessary to avoid or mitigate adverse legal or regulatory impacts on us.
If you believe your account has been terminated in error, or if you want to disable or permanently delete your account, consult our Help Center. When you request to delete content or your account, the deletion process will automatically begin no more than 30 days after your request. It may take up to 90 days to delete content after the deletion process begins. While the deletion process is being undertaken, the content is no longer visible to other users but remains subject to these Terms of Service and our Privacy Policy. After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.
Retention of Publicly Available Plans and Workouts
If you delete your account and it contains publicly available plans, workouts, or other structured content that is in use by other users, we will retain the structured workout/plan data to ensure that other users' experiences are not disrupted. In such cases, ownership of this structured content will be transferred to Superhuman, allowing us to continue providing the Service seamlessly to other users. However, any media content (e.g., photos, videos) attached to these plans or workouts will be deleted in a manner that does not disrupt the experience for others.
Content will not be deleted within 90 days of the account deletion or content deletion process beginning in the following situations:
In such cases, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis).
If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but this section and the section below called "Our Agreement and What Happens if We Disagree" will still apply even after your account is terminated, disabled, or deleted.
2.8 Mobile Services
The Service may include certain services that are available via a mobile device, including (i) the ability to upload content to the Service via a mobile device, (ii) the ability to browse the Service and the Site from a mobile device and (iii) the ability to access certain features through an application downloaded and installed on a mobile device (collectively, the “Mobile Services”). To the extent you access the Service through a mobile device, your wireless service carrier’s standard charges, data rates and other fees may apply. In addition, downloading, installing, or using certain Mobile Services may be prohibited or restricted by your carrier, and not all Mobile Services may work with all carriers or devices. In using the Mobile Services, you may provide your telephone number. By providing your telephone number, you consent to receive calls and/or SMS, MMS, or text messages at that number. We may share your phone numbers with our affiliates or with our service providers (such as customer support, billing or collections companies, and text message service providers) who we have contracted with to assist us in pursuing our rights or providing our Services under these Terms of Service, our policies, applicable law, or any other agreement we may have with you. You agree these parties may also contact you using autodialed or prerecorded calls and text messages, as authorized by us to carry out the purposes we have identified above, and not for their own purposes. In the event you change or deactivate your mobile telephone number, you agree to promptly update your Superhuman account information to ensure that your messages are not sent to the person that acquires your old number.
